The begining of the end?

Yesterday I signed the final contract for division of marital property.
In the end, I accepted 38% of the total holdings, the remainder went to Kyle. Of the 38% I received....29% went to legal fees....after all, it's been a year since the assets were liquidated.
Lawyers are supposed to be holding the moneies in trust, in interest bearing accounts. Apparently, Kyle's lawyer forgot to do that, so after a year, there was no interest generated. Oh well, only a couple thousand dollars. >:(
I gave up.
I got tired of fighting for fairness with a man who is so psychopathically selfish.
Good thing I quit when I did. Lawyers are expensive, even when they're just writting letters and making phone calls.

I could have sued Kyle for fair division, but each court visit costs about $800, for 15 mins with a busy judge, in front of open court....never a consistant judiciary member for each case, it depends on which Judge is assigned to Family Court that day.

The system is dresdfully broken.
Were there cases specifically assigned to a judge, to see through to the end, and each court appearance were in front of that same judge, my case would not have dragged on nearly as long.
The same judge would have seen us each time, the compilation of crap Kyle pulled over and over would have been more easily recognizable, the games would have been seen for what they are, he would have been sanctioned for his bullying. However, instead of that, I was appearing before a random judge, with a small issue, repeatedly going to court, facing different judges for each issue...and begining to look like a court room hover craft. In an assigned to a specific judge senario, the same Judge could have remembered the prior appearances and the similarities of the issues, the lump sum affect and effect of Kyle's behavior on both our finances, the girls psyche and my sanity and made rulings accordingly. The way the system is, we were at the mercy of the politics, experiance and mood of any judge on that particular day. It's a fuckin craps shoot....these are families lives at stake!

Kyle was easily able to get away with bullying, lying, false allegations, character slander, parent alienation, withholding access of the children, non payment of child support, spousal support, section 7 expenses, unfair division of debt, unfair division of assets and property (he got everything and I got the computer) withholding equal shares of the rental income from the marital home, deceit, failing to follow through on contractual agreements....the list is endless.

Just fix the system.

Family court is supposed to provide a haven of justice to families in crisis...but all it really is, is a puppet ruler for those who are the most devious and have the most money to spend. That shit is fucked.

Anyway. It's almost over. I have to get child support and a ruling for section seven expenses (which are the medical bills, therapy bills, extracurricular activity fees, school fees, sport fees, bus fees, child care costs, to be shared expenses based on income ratios)

  1. Yup, the system is broke. I now hear so many stories of flawed justice. My fave is the story of a dad who was extremly verbally abusive, but since it was only verbal there was NOTHING any of the attending cops could do. They all told him what a %$&#@ he was but they had to leave the kids in a horrid situation.
    It does seem that the powerful prosper and the innocent are often hurt.
